The Demise of the 28-Article Ceasefire Plan for Ukraine: Why Diplomatic Efforts Continue to Stumble

Europe breathed a deep collective sigh of relief on Monday, as the diplomatic emergency sparked by the presentation of a new 28-article proposal for ending the war appeared – momentarily – to have been contained. A Washington representative spoke of "notable headway" after bilateral negotiations in Geneva. On Monday night, Moscow made its response: a renewed assault of rocket attacks on Kyiv.

The Pattern of Negotiation and Warfare

The succession of conflicting incidents captured the grim essence of the current period. By day, political struggles are waged: optimistic declarations are delivered from different nations. Immense energy is devoted on restraining certain initiatives. By night, Russian leadership forcefully demonstrates the world that, for them, conflict continues to be the key method for achieving "settlement".

Nocturnal Warfare

As military strikes progressed into the early hours of Tuesday, the current condition of Ukraine's vulnerability was revealed. Ukraine is able to track missile launches from across the border, a capability enabled by up-to-date information. From witness perspectives, Ukrainian air force fighter jets that had been dispatched to intercept incoming cruise missiles roared overhead – modern combat jets provided to Ukraine by Western partners.

Soon thereafter, Kyiv's missile defense activated: defensive missiles deployed against a Russian ballistic missile. This was a advanced protection mechanism at work, presumably provided by Western nations. Every deployment shakes the surroundings, shaking the windows. The instant of fear quickly gives way to grim resignation: possibly the approaching threat won't hit its mark this time, protecting urban areas from catastrophe and another blackout.

Ongoing Risks

Soon after, a heavy machine gun opened up on a unmanned aircraft somewhere nearby, part of a mobile-fire group – most likely imported technology. Unfortunately, the bullets missed the hostile drone – it continued its flight toward its objective.

With pauses, this persisted until dawn. Kyiv awoke to the early updates: several casualties, damage and infrastructure problems in many homes as a result of the nocturnal offensive. As customarily, everyone still maintained normal activities – enduring hostilities. But those entire period encapsulated Ukraine's essential dependence on external assistance – a dependence that regional partners are demonstrably unable to replace in the short term.

Failed Diplomacy

The comprehensive proposal from American leadership provoked deep reactions, debate and profound anxiety – and temporarily diverted attention from Ukraine's major integrity crisis in years. Yet, we have experienced comparable situations, after previous diplomatic encounters and multilateral gatherings.

Every new initiative from American administration unfolds according to the same pattern: a political offensive against Ukraine, which Kyiv, with other European capitals, manages to fend off. They manage the tension but never actually win the battle. This trend will, no doubt, continue.

Strategic Calculations

It is tempting to accuse specific actors of consistently pushing Moscow's conditions. But that does not seem to be the entire situation. American leadership works based on a premise well known to experienced diplomats: you cannot achieve through diplomacy what you have lost on the battlefield. The US administration believes that it is unrealistic to pressure the Kremlin to relinquish the land that it currently occupies in Ukraine's occupied territories.

The issue is that while recognising this factual reality, US leadership does minimal to discourage Russia, through diplomacy or military means, from thinking that the situation will not change more in its favour in the coming year.

Divergent Views

Therefore, Russian leadership is certain that the clock favors them – that Ukraine and its supporters are nearing depletion. Their reason to sign a deal that does not give them the largest achievable advantage is almost completely absent. There may be multiple initiatives to end hostilities, but they will persist as long as Russia's leadership remains completely certain in the conclusion.

On the contrary, Ukrainian leadership believes that Ukraine can still persist, slowly losing people and territory but preventing a entire defensive failure until circumstances change in its advantage.

Current Realities

Factually, there are no genuine requirements for a armistice. Now, personal considerations are coming into play: leadership ambitions to mediate resolution and obtain worldwide acknowledgment, and Kyiv's double obstacles – on one hand, not to distance important partners, and on the other, to rally Ukrainians around the country's interests against any proposal Kyiv finds unacceptable, so that their attention does not switch to internal issues. And although their objective will now be significantly challenging after current events, it remains quite doubtful that this will change their overall approach.

These opposing factors are driving the talks.

Assessment and Future

It took a only one week to terminate the 28 points of the most recent proposal. Forceful and unpredictable management of the matter by US administration, resistance by Ukraine and the rest of Europe, along with calming attempts of negotiators, and finally, recent disclosures, all did their job.

While new initiatives based on old ideas are approaching, Kyiv, London and other European capitals should reach an essential realization: Ukraine and Europe will only be able to fend off negotiation assaults from Washington that are rooted in Kremlin requirements and reflect particular unwillingness to alter the situation, if they stand together and strengthen their defence capabilities at a significantly accelerated rate. If they do, neither political nor armed coercion will be able to overcome them. In the meantime, Ukraine's ability to defend against evening bombardments will, for the coming months, primarily depend on continued Western support.
